Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fladin (the "Service"), operated at https://fladin.com. By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Fladin is an AI-assisted content platform that lets users create AI influencer characters, generate images and (in future releases) videos based on those characters, and schedule or publish that content to third-party social networks such as Instagram, TikTok, X, Threads, and YouTube. Feature availability depends on your subscription plan.

2. Account Registration

You must be at least 18 years old to use the Service. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity that happens under your account. Notify us immediately at support@fladin.com if you suspect unauthorized use.

3. Acceptable Use

You agree not to use the Service to:

  • Generate content depicting real, identifiable people without their explicit consent, including public figures, minors, or any non-consensual sexual or defamatory content.
  • Produce content that is illegal, hateful, harassing, violent, deceptive, or designed to impersonate another person or brand.
  • Upload reference photos you do not own or do not have rights to use.
  • Violate the terms of the third-party social networks you connect (Instagram, TikTok, X, Threads, YouTube, etc.).
  • Reverse engineer, scrape, resell, or attempt to extract the Service's underlying models or code.
  • Interfere with the integrity, security, or performance of the Service.

We may suspend or terminate accounts that violate this section without prior notice.

4. AI-Generated Content

The Service uses third-party AI models to produce outputs from your prompts and reference images. You are responsible for reviewing each output before publishing it. AI outputs may be inaccurate, unoriginal, or resemble content produced for other users. You should not rely on AI outputs for medical, legal, financial, or other professional advice.

5. Ownership and License

You retain ownership of the reference photos and prompts you upload ("Inputs"). Subject to your compliance with these Terms, we grant you a worldwide, royalty-free license to use the content generated from your Inputs ("Outputs") for any lawful purpose, including commercial use. You grant Fladin a limited license to host, process, and display your Inputs and Outputs solely to operate, secure, and improve the Service.

6. Subscriptions, Credits, and Billing

Paid plans (Creator, Studio, Agency) are billed in advance via Stripe on a monthly or annual cadence. Monthly image generations, posts, and connected-account limits reset each calendar month and do not roll over. You can upgrade, downgrade, or cancel at any time; downgrades and cancellations take effect at the end of the current billing period and we do not offer pro-rata refunds for partial billing periods. Failed payments may result in a downgrade to the Free tier. We may change pricing with at least 30 days' notice.

7. Third-Party Services

The Service integrates with third parties (e.g., Stripe for billing, Supabase for authentication and storage, bundle.social for social posting, and various AI model providers). Your use of those integrations is also governed by their terms. We are not responsible for the availability, content, or actions of third-party services.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or events beyond our control. We may also add, modify, or remove features at any time.

9. Termination

You may delete your account at any time from the dashboard. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way we reasonably believe is harmful. On termination we will delete your account data in line with our Privacy Policy.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Fladin and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising out of your use of the Service. Our total aggregate liability under these Terms will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Fladin harmless from any claim or demand (including reasonable legal fees) arising from content you upload or generate, your use of the Service, or your violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws applicable to the operator's principal place of business, without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of that jurisdiction.
